1 Purchase
If you want to purchase on Dave Guccione Visual website you must:
– Select the product you are interested in and open the product page;
– Select the quantity you want to buy. Please note that DESIGN and ART sections contain mainly unique items that cannot be reproduced.
– Select ‘add to cart’
Please check your order and after that you can click ‘proceed to checkout’
Enter your data for the heading of the invoice and the address for the delivery.
Now select the method of payment, read and accept the terms and conditions of the service and withdrawal.
Click ‘place order’: you will be redirected to the website of the credit card gateway or on the order confirmation page according to your payment method
Within few minutes you will receive a confirmation email from ordini@daveguccionevisual.com with all the details of your order.
If you cannot find the email, please check in the spam folder and then save our email address in your contacts.
If you like an artwork but it’s no longer available if you would prefer it in different colors or shapes, please contact me at info@daveguccionevisual.com so we can discuss a custom artwork together
2 Prices and payments
All prices in Dave Guccione Visual website include VAT and taxes and for this reason they may vary. Dave Guccione Visual reserves the right to change its prices at any time. All prices may be amended at any time due to variations in the market or mistakes in the original pricing.
The prices for the orders undergoing processing shall not be changed.
Deliveries will be made after the full payment is received. Dave Guccione Visual will notify via email the order status.
In Dave Guccione Visual website you can use the following payment methods:
PayPal: it’s a secure server and you can pay with your credit card. The order release is immediate and the shipping time is reduced.
Credit Card: the transaction is safely made through Stripe server that deals with data management. Within our server, no traces of the data used for the payment remain. The order release is immediate and the shipping time is reduced.
Bank Transfer: this method would increase the shipping time, due to the procedures needed to validate the transaction. The delivery will be made after the payment is credited in our bank account.
3 Placed orders
Each order received by Dave Guccione Visual will be fulfilled after receiving the due payment. Each order represents a contract proposal from the consumer. Each order is binding only if Dave Guccione Visual confirms it. The order fulfillment represents the confirmation and acceptance of the order by Dave Guccione Visual.
4 Received orders
Dave Guccione Visual verifies each package before sending it to the consumer. We suggest you to check the package when you receive it in order to verify that it is intact and not altered.
In case of tampering or damages, the consumer shall contest the shipping and/or the delivery. If artworks are damaged a report shall be made within 5 working days after receiving the delivery.
5 Guarantee of conformity
Dave Guccione Visual guarantees the integrity of the artwork at the time of shipping and for the whole time in the studio. As each artwork is unique and handmade, some faults or variations in colour or material are intentional and enhance the beauty of the product.
Any variation due to damages during the shipment or negligent use of the product are not to be considered as intentional faults.
6 Prices
All prices include VAT. Dave Guccione Visual reserves the right to modify or update the prices of the products in the online catalogue or in advertising materials. The images of the artworks are suggestive of the original artworks and therefore those are not binding.
7 Invoicing
Dave Guccione Visual will issue an invoice for each order. A copy of the invoice will be found in your package therefore a valid VAT number or fiscal code \ tax code is needed for the invoice.
The invoice shows the details of each order and the consumer details entered by the consumer himself. In case of any problem, please send a message to our account department from Monday to Friday at the following email address info@daveguccionevisual.com
SHIPPING AND WITHDRAWALS
1 Shipping Cost
Shipping will be made through an express courier, who will deliver the package approximately within 48/72 hrs after the departure of the order. Shipping costs are free of charge for Italy.
For the rest of the world a shipping cost will be added at checkout (to the final order amount.)
Additional shipping costs are also applicable for some areas in Italy which are difficult to reach for the courier. Consumers will be informed about these costs during the preparation of the order and before the shipping.
By any reason, it is reminded that the burden of proof related to the exercise of the right of withdrawal shall be borne by the consumer
2 Delivery Time
Shipping will be made through an express courier, who will deliver the package approximately within 48/72 hrs after the departure of the order.
In case of custom artworks, shipping time may vary and it will be defined with consumer each time.
In case of payment by bank transfer, the package will be shipped after the due amount is credited to our bank account.
Shipping time may vary due to force majeure, traffic condition, government regulations and Dave Guccione Visual shall hold no liability for any delay in order fulfillment or delivery.
3 Right of withdrawal
The Consumer is entitled to withdraw from the online sales agreement without any penalty and without providing any reason within 14 (fourteen) days pursuant to Article 52, paragraph 2 of the Civil Code. The withdrawal period shall elapse after 14 days.
In order to correctly exercise his or her right of withdrawal, the Consumer shall express his or her decision to withdraw from the contract by forwarding an explicit notice to the Seller following the above mentioned procedures before the withdrawal period has elapsed: the right of withdrawal shall be deemed correctly exercised if the above mentioned notice is sent to the Seller before the withdrawal period elapses. It is reminded that the burden of proof related to the exercise of the right of withdrawal shall be borne by the Consumer.

EXCLUSION OF THE RIGHT OF WITHDRAWAL
The User/Consumer is fully informed and aware that, pursuant to Article 59, paragraph 1, sub-paragraph c) of Legislative Decree No. 206/2005 (Consumer Code), the right of withdrawal is excluded as regards the Services provided by Dave Guccione Visual in the following cases:
– The returned product is damaged
– There is no original package
– The product is damaged for reasons that don’t involve the courier
– Lack of parts of the product
– The product was used
– No refund or replacements will be made, should the request be noticed after the 14 days deadline.
It is reminded that the burden of proof related to the exercise of the right of withdrawal shall be borne by the Consumer.
The return of damaged products won’t be accepted by Dave Guccione Visual and it will be sent back to the Consumer with the additional charge for the shipping.
The refund is credited to the same credit card used for the payment or to the bank details given during the payment procedures. The refund is made within 14 days from the shipping date of the products. The shipping date shall be communicated by the Consumer via email to info@daveguccionevisual.com
In case the price of a product is wrong or evidently too low due to technical or human mistake, the order will be cancelled even if it was initially confirmed.
